The NYC Department of Finance (DOF) is responsible for administering the tax revenue laws of the city fairly, efficiently, and transparently to instill public confidence and encourage compliance while providing exceptional customer service.
The Tax Audit and Enforcement Division is charged with the audit of all business and excise taxes administered by New York City. The division conducts audits related to corporate, personal, sales, and use taxes. City tax auditors conduct audits of selected audit candidates with a goal of determining the appropriate tax liability of each taxpayer and applying NYC rules and laws in accordance with the City’s policies and procedures.
DOF is seeking an experienced legal professional to serve as Senior Legal Advisor of Tax Audit Resolution in direct support of tax audit operations. Reporting to the Assistant Commissioner of Tax Audit, the Senior Legal Advisor of Tax Audit Resolution responsibilities include, but are not limited to the following:
- Serve as technical legal advisor on NYC tax audit issues for the Tax Audit & Enforcement Division and provide guidance to the Audit Division.
- Provide interpretations of tax law, regulations, case law and administrative rulings and Tax Audit policies and procedures.
- Review and make recommendations regarding case settlement, negotiation and agreements with taxpayers and their representatives regarding audit matters.
- Participate in meetings with taxpayers and audit staff seeking a resolution of business corporation, general corporation, commercial rent, real property transfer, utility, hotel, unincorporated business, and bank tax audits.
- Work with taxpayers and taxpayers' representatives on audit related issues and settlement discussions.
- Evaluate and confer with division managers on audit policy & procedures and Statements of Audit Procedures (SAPs)
- Participate in the development of comprehensive training programs.
- Prepare and review reports and other documents.
- Perform legal research and draft memoranda, legal responses, policy statements and other documents.
- The selected candidate will be responsible for communicating objectives consistent with the agency's and the Audit Division's goals and monitor performance and productivity.

Admission to the New York State Bar; and four years of recent full-time responsible, relevant, satisfactory legal experience subsequent to admission to any bar, eighteen months of which must have been in the supervision of other attorneys, in an administrative, managerial or executive capacity, or performing highly complex and significant legal work.
Incumbents must remain Members of the New York State Bar in good standing for the duration of this employment.
