The Law Department is now accepting applications for the position of Assistant Corporation Counsel in the Administrative Law & Regulatory Litigation Division. The Administrative Law & Regulatory Litigation Division handles State and Federal court proceedings brought by and against the numerous City agencies that are responsible for administering and enforcing laws and regulations in the areas of public health, land use, licensing, use of the streets, transportation, public housing, building and fire codes, among others, so as to enhance the quality of life of its citizens and visitors. Some of these actions include challenges to the provisions of law themselves, while most dispute the application of a particular legal requirement in a specific context. Many cases raise constitutional claims, including First and Second Amendment challenges, challenges to various City regulations and orders on Due Process and Equal Protection grounds, among others; and many cases involve challenges that the regulations or policies at issue violate state or federal statutory provisions. The Division handles cases for over 20 different City agencies and the five City-run Pension Funds. The hired candidates will defend Article 78 proceedings and actions in state and federal courts, challenging enforcement against unlicensed cannabis establishments. In addition to our varied defensive practice, the Division brings some civil actions to obtain compliance with regulatory requirements, and prosecutes code violators in New York Criminal Court to punish their non-compliance and ultimately bring about code compliance. The hired candidates will be responsible for independently handling a caseload comprised of these sorts of actions from beginning to end including preparing pleadings and affidavits after reviewing agency records and consulting with agency representatives, researching and writing memoranda of law, conducing necessary discovery, making court appearances to argue motions, and taking cases if appropriate to trial, as well as prosecuting violations and misdemeanors in Criminal Court.

All applicants must be admitted in the State of New York with at least two years of experience following graduation from an ABA approved law school. Applicants must have superior organizational, time-management, research and writing and oral advocacy skills. Applicants should have a demonstrated record of independently litigating matters in the courts. Prior regulatory or municipal law experience is preferred, but not required.
